These Terms of Service govern your access to and use of the Vortex Labs website and your purchase of products from us.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service. Please do not use the website or place an order if you do not agree to these terms.

1. About Vortex Labs

In these terms, “Vortex Labs”, “we”, “us” and “our” refer to the business identified above.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.

By placing an order, you confirm that:

• The information you provide is accurate and complete.
• You are purchasing for a lawful purpose.
• You will comply with all applicable Commonwealth, state and territory laws.
• You are authorised to use the selected payment method.

We may request additional information or verification before accepting or dispatching an order.

3. Research-Use Products

Products displayed by Vortex Labs are supplied strictly for lawful laboratory, analytical or research purposes only.

Unless expressly stated otherwise, products are not intended for:

• Human consumption
• Self-administration
• Therapeutic or diagnostic use
• Veterinary use
• Food, cosmetic or household use
• Resale for an unlawful or unauthorised purpose

You are responsible for determining whether your intended purchase, possession and use are lawful in your jurisdiction.

We may refuse or cancel an order where we reasonably believe that accepting or fulfilling it may breach a law, regulatory requirement, payment-provider rule or carrier restriction.

Nothing in these terms represents that every product is approved by the Therapeutic Goods Administration or permitted for every possible use.

4. Product Information

We take reasonable care to present product names, specifications, strengths, quantities, images, prices and availability accurately.

Product photographs are provided for illustration. Packaging, labels, colours and appearance may differ slightly between batches.

You must review the selected product, strength, quantity and delivery information before completing checkout.

Where documentation or a certificate of analysis is made available, it applies only to the product or batch identified in that document. Documentation must not be treated as applying to a different product or batch.

5. Product Availability

Product availability may change without notice.

A product appearing on the website does not guarantee that it is immediately available for dispatch.

Products that are out of stock may experience an estimated 7–14 day delay while inventory is replenished. This timeframe is an estimate and may be affected by supplier, freight, customs or other delays outside our reasonable control.

When an order contains both in-stock and out-of-stock products, we may hold the complete order until all products are available.

6. Prices

Unless stated otherwise, prices are displayed in Australian dollars.

Shipping fees and any other applicable charges will be shown before the order is submitted.

We may change prices at any time. A price change will not affect an order that we have already accepted and confirmed, unless there has been an obvious pricing or technical error.

If a product is listed at an incorrect price, we may cancel the affected order and issue a refund through the original payment method.

7. Payments

We accept the payment methods displayed at checkout.

Payment must be successfully completed or confirmed before an order is processed or dispatched.

You are responsible for:

• Providing accurate payment information
• Paying any fees charged by your bank, payment provider or cryptocurrency network
• Sending the correct payment amount
• Using the correct payment address or network where cryptocurrency is accepted

Cryptocurrency transactions may be irreversible. Vortex Labs is not responsible for funds sent to an incorrect address or through an unsupported network where the error was not caused by us.

8. Order Acceptance

Submitting an order does not automatically mean that we have accepted it.

An order is accepted when we confirm it, begin processing it or dispatch it.

We may refuse or cancel an order due to:

• Product unavailability
• Incorrect pricing or product information
• Suspected fraud or unauthorised payment
• Incomplete customer information
• Suspected unlawful purchasing or intended use
• Regulatory, payment-provider or shipping restrictions
• Circumstances outside our reasonable control

If we cancel an order after payment has been received, we will provide the appropriate refund unless the payment is subject to a lawful hold, chargeback, fraud investigation or another restriction outside our control.

9. Shipping

Vortex Labs currently ships within Australia only.

All orders are sent using Express Shipping at a flat rate of $20 AUD per order.

Orders are prepared after payment has been confirmed. Tracking information will be sent to the email address provided at checkout after dispatch.

Shipping and delivery estimates begin from the dispatch date and are estimates only. Delivery may be affected by carrier disruptions, weather, public holidays, remote locations and other events outside our reasonable control.

Our separate Shipping Information page forms part of these Terms of Service.

10. Delivery Address

You are responsible for entering a complete and accurate delivery address.

Contact vortexlabsaus@gmail.com immediately if an address needs to be changed. We cannot guarantee that an address can be changed after an order has entered processing or been dispatched.

Additional shipping charges may apply where a parcel is returned because it was:

• Incorrectly addressed
• Unclaimed
• Refused
• Not collected
• Returned because of information supplied by the customer

A further $20 Express Shipping payment may be required before a returned parcel is dispatched again.

This does not limit any rights you may have where the delivery problem was caused by Vortex Labs.

11. Order Changes and Cancellations

Contact us as soon as possible when you need to change or cancel an order.

We may be unable to change or cancel an order after it has:

• Entered processing
• Been packed
• Been dispatched
• Been submitted to a supplier for fulfilment

Approved refunds will normally be returned through the original payment method.

Payment processing, banking and cryptocurrency network times are outside our control.

12. Change-of-Mind Returns

Unless otherwise agreed, Vortex Labs does not offer refunds or exchanges for change of mind, incorrect product selection or a strength or quantity ordered incorrectly by the customer.

This change-of-mind policy does not limit your rights under the Australian Consumer Law.

13. Faulty, Damaged or Incorrect Products

Contact vortexlabsaus@gmail.com as soon as reasonably possible if an order arrives faulty, damaged, incorrectly supplied or materially different from its description.

Include:

• Your order number
• A description of the issue
• Photographs of the product
• Photographs of the external packaging
• A photograph of the shipping label

Keep the product and packaging until the matter has been reviewed.

We may request that an affected product be returned or otherwise made available for assessment. We will not require you to pay return expenses where doing so would be inconsistent with your rights under the Australian Consumer Law.

14. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund or compensation where a product fails to satisfy an applicable consumer guarantee.

15. Lost or Missing Deliveries

When tracking has stopped updating or a parcel appears to be missing, contact us with your order and tracking numbers.

We may assist you in lodging an investigation with the shipping carrier.

Where tracking shows that a parcel has been delivered, you should first:

• Check the delivery location and any safe-drop area.
• Ask members of your household.
• Check with neighbours, reception or building management.
• Contact the shipping carrier.

A carrier investigation may be required before a replacement, refund or other resolution is determined.

Nothing in this section limits rights that cannot be excluded under the Australian Consumer Law.

16. Customer Accounts

You are responsible for maintaining the confidentiality of your account details and password.

You must notify us promptly if you suspect unauthorised access to your account.

We may suspend or close an account used for:

• Fraud
• Payment abuse
• Chargeback abuse
• Unlawful conduct
• Interference with the website
• Breach of these terms
• Harassment or threats toward staff or other users

17. Prohibited Conduct

You must not:

• Use the website for an unlawful or fraudulent purpose.
• Provide false or misleading information.
• Attempt to gain unauthorised access to the website or another account.
• Introduce malware or interfere with the website’s operation.
• Scrape, copy or commercially exploit website content without permission.
• Make purchases using stolen or unauthorised payment information.
• Purchase products for unlawful supply, administration or resale.
• Misrepresent your relationship with Vortex Labs.
• Use our products, branding or documentation to make unauthorised medical or therapeutic claims.

18. Intellectual Property

The Vortex Labs name, logo, website design, product images, written content and other original materials are owned by or licensed to Vortex Labs.

You may not copy, reproduce, modify, distribute, publish or commercially exploit this material without prior written permission, except where permitted by law.

19. Third-Party Services

The website may use third-party services for hosting, payment processing, order management, fraud prevention, analytics and shipping.

Your use of those services may also be subject to their terms and privacy policies.

We are not responsible for an independent third-party service except to the extent that liability cannot lawfully be excluded.

20. Privacy

We collect and handle personal information in accordance with our Privacy Policy.

By placing an order, you authorise us to provide necessary information to payment processors, shipping carriers, fraud-prevention providers and other service providers involved in processing and fulfilling the order.

21. Website Availability

We do not guarantee that the website will always be available, uninterrupted or free from technical errors.

We may update, suspend or withdraw parts of the website for maintenance, security, operational or legal reasons.

22. Limitation of Liability

To the maximum extent permitted by law, Vortex Labs is not liable for loss caused by:

• Unlawful, unauthorised or improper use of a product
• Failure to follow product storage or handling information
• Incorrect information supplied by the customer
• Events outside our reasonable control
• Unauthorised access caused by a customer failing to secure their account

Nothing in these terms excludes liability or rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.

23. Changes to These Terms

We may update these Terms of Service to reflect changes to our website, operations, products or legal obligations.

The updated terms will be published on this page with a revised “Last updated” date.

Changes apply from publication and do not retrospectively remove rights relating to orders already accepted.

24. Severability

If a provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.

25. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia.

The parties submit to the courts and tribunals with jurisdiction in New South Wales, subject to any rights a consumer may have under applicable law.
